BOOKING CONDITIONS

Please read carefully: VIA CARPATHIA Ltd. ("the company") accepts bookings subject to the following conditions:

1. YOUR HOLIDAY CONTRACT WITH VIA CARPATHIA

The contract is between the company and the client, being any person travelling or intending to travel on a tour operated by the company. The contract including all matters arising from it, is subject to Slovak Law. No employee of the company has any authority to vary or omit any of these terms.

The fundamental requirement from the company to secure a booking, is to obtain a completed booking form and the necessary deposit from the client.
All the clients booking on the web site, by e-mail, telephone or fax will be deemed to agreed to the following conditions:
a) they have read and agree with the Booking conditions on company's web site
b) the person booking a holiday warrants that he/she has full authority to do so on behalf of all persons whose names appear thereon, and confirms that all these persons are fully aware and accept the company's Booking conditions. A booking is accepted and becomes definite only from the date the company sends a confirmation invoice. It is at this point that a contract between the company and the client comes into existence.

2. PAYMENT FOR YOUR HOLIDAY

Full payment must be made to the company not later than 40 days before departure. In the case of non-payment of the balance by the due date, the company reserves the right to cancel your booking and cancellation charges will apply.
All payments affected through internet on our website from client´s credit or debit card will be affected in Slovak Crowns.
Please check with your bank for exact exchange rate.
Information about exchange rates on our website is provided in a good faith but without responsibility on the part of the company.

3. IF YOU CHANGE YOUR BOOKING (regards only Tailor made holidays)

If a booking of a tailor made holiday is already confirmed by the company and the client changes any of secured services, the company is entitled to charge any additional cost incurred.

4. IF YOU CANCEL YOUR BOOKING

Should the client wish to cancel, cancellation charges will be imposed.
These are calculated from the day 39 before departure as shown below:

a) 40 and more days before departure 0%
b) 39 - 29 days before departure 30%
c) 28 - 19 days before departure 60%
d) 18 - 10 days before departure 90%
e) less than 10 days 100%


5. IF YOU HAVE A COMPLAINT

Should the client have a complaint about any of the tour arrangements, the client must tell both the relevant supplier and the company's representative at the time. It is only if the company and the relevant supplier know about problems that there will be the opportunity to put things right. If the client does not make a claim at the place and time of the complaint, it can cause that any compensation from the company may be removed or reduced.

6. PASSPORTS AND VISAS

Clients are responsible for arranging and must be in possession of a valid passport and any visas (if necessary to countries of Central Europe) required for the whole of their journey. Information about these matters or related items (clothing, baggage, personal gear etc.) is given in a good faith but without responsibility on the part of the company. 7. TRAVEL AND CANCELLATION INSURANCE

Travel insurance is mandatory for all clients whilst on a tour organised by the company. Clients are wholly responsible for arranging their own travel insurance in their own country, for the full duration of the tour in respect of at least medical expenses, injury, death and cancellation, with adequate cover.Clients not taking out the insurance, take part in the tours at their own risk.

8. HOLIDAY PARTICIPATION

Clients agree to accept the authority and decisions of the company's employees and tour guides within the tour with our company. The person booking a holiday warrants that he/she has full authority to do so on behalf of all persons whose names appear thereon, is over 17 years of age and confirms that all such persons are fully aware of and accept these conditions.

9. PRICES

All prices are based on SKK.
Conversions to other currencies only have informational character and are not considered in the contract between the client and the company.
All payments affected through internet on our website from client´s credit or debit card will be affected in Slovak Crowns. Please check with your bank for exact exchange rate.
Information about exchange rates on our website is provided in a good faith but without responsibility on the part of the company.
Each description of the tour includes detailed note with all items included in the price.The price never includes the transport costs (air tickets, train tickets, bus tickets, etc.) to "STARTING POINT" and from the "FINAL POINT" of client's holiday.

"STARTING POINT" is :
a) a place, at which the client will start his/her holiday in Central Europe according to itinerary
b) a place, at which the company's guide picks the client up (if he/she requests one).

"FINAL POINT" is:
a) a place, at which a client's holiday in Central Europe ends according to itinerary
b) a place, at which the company's guide will take leave of the client.

ONLY FOR TAILOR MADE HOLIDAYS:
The client obtains the exact price calculation always together with itinerary till 30 days from the date of sending of a completed booking form.
In case the client is not satisfied with elaborated itinerary and requires the company to make changes in it, it can come to a change (increase or
decrease) of the price of the holiday.

10. IF WE ARE FORCED TO CHANGE YOUR HOLIDAY

While the company will use its best endeavours to operate all holidays as advertised, it reserves the right to change any of the facilities, services, prices or itineraries described on the web site, on the behalf of securing the highest possible quality of services and client's satisfaction.If a major change is necessary or deemed advisable, the company will inform the client as soon as reasonably possible, if there is time before departure.

A major change does not apply to a change of transport or named accommodation, but is normally considered to be a major itinerary re-routing or a significant change in the duration of your holiday. If advised of a major change before departure the client will have the choice of accepting the changes (at additional costs if applicable) or cancelling the tour with a full refund; provided that the major change is not as a result of situations outside the company's control or consolidation (see below).
Compensation will be paid as follows:

The company will not pay compensation if forced to cancel or change your tour because of civil strife, natural disaster, fire or adverse weather condition, technical or maintenance problems with transport, or other similar events beyond the control of the company.

The company is not responsible for any possible penalty charges associated with transport to "STARTING POINT" or from "FINAL POINT" of the tour.

11. IF WE CANCEL YOUR HOLIDAY

The company reserves the right to cancel a holiday in any circumstances but will not cancel a holiday less than 6 weeks before departure except for force majeure, consolidation of the client's failure to pay the final balance. Unless the client fails to pay the final balance, the company, upon cancellation, will return all money paid not including visa, transport costs to STARTING POINT and from FINAL POINT of the client's holiday or associated costs, or offer an alternative tour of comparable standard and will pay compensation on the scale shown in clause 10 above. No compensation will be paid if cancellation is because of force majeure or consolidation.

12. OUR RESPONSIBILITY FOR YOUR HOLIDAY

The company accepts liability should any part of the tour arrangements booked with the company not be supplied as described in the itinerary. In such a case, the company will pay reasonable compensation if the clients enjoyment of the tour arrangements has been adversely affected but will pay no compensation if there has been no fault on the part of the company or its suppliers and the reason for the failure in the tour arrangements was the client's fault, the actions of someone unconnected with the tour arrangements or could not have been foreseen or avoided by the company even if all due care had been exercised.
